This contract is between Top End motorcycle Hire Pty Ltd (the "Business") and Ash Nsash (the "Client") dated

The Client is hiring Top End Motorcycle Hire Pty Ltd for the services described in this contract.

The Business will invoice the Client after completion of milestone(s) or the Project, unless otherwise noted in the Payment schedule. The Client agrees to pay invoice(s) by the due date(s) specified. Unpaid or overdue invoices may result in suspension or termination of the Project.

This Agreement shall commence on the day the Renter takes possession of Motorcycle and remain in full force and effect until the End Date and the Motorcycle is returned to Owner. Renter shall return Motorcycle to the agreed return location. If Motorcycle is not returned on End Date, Owner reserves the right to take any action necessary to regain possession of the Motorcycle. Owner reserves the right to terminate this agreement earlier upon notice to the Renter.

Each party has the authority to enter into this Contract and to perform all of its obligations under this Contract.

The Client and the Business must agree to any changes to this contract in writing.

Payment will be made to the Business via cash, cheque, an approved payment card, or by any other payment method that is accepted by the Business.

The Business promises that it holds all licenses necessary to perform the work, that such licenses are valid and effective as of the date any work is performed or services provided, and that all work performed or services provided will be done in compliance with all applicable federal and state , or local laws and regulations.

The Owner represents that to the best of his knowledge and belief that the Motorcycle is in sound and safe condition and free of any known faults or defects that would affect its safe operation under normal use.

Renter acknowledges that Renter has examined the Motorcycle and that it is in good condition except as otherwise specified.

Renter shall not allow any other person to operate the Motorcycle, operate the Motorcycle in violation of law, including but not limited to driving under the influence of alcohol or drugs; Renter shall not operate the Motorcycle for any race, test or contest.

Parts and accessories shall not be replaced or repaired without Owner’s prior consent. In the event Renter is in an accident, has an incident or if Motorcycle is subject to theft or vandalism Renter shall report the accident or incident to Owner as soon as practicable.

Renter shall indemnify, defend and hold harmless Owner from and against any claim, demand, cause of action, loss or liability for any property damage or personal injury arising from Renter’s use of Motorcycle by any cause, except to the extend caused by Owner’s negligence or wilful misconduct. In no event shall Owner be responsible for any direct, special or consequential loss or damages arising from Renter’s use of Motorcycle, including but not limited to loss profits and loss revenue even if informed of such damages or possibility of such damages. The provisions of this Article shall survive the termination of this Agreement with respect to any claims or liability accruing before such termination.

This Agreement represents the entire understanding relating to the subject matter hereof and prevails over any prior or contemporaneous, conflicting or additional communications. This Agreement can only be modified by a written amendment signed by the Party against whom enforcement of such modification is sought.

This Agreement, and any amendment thereof, may be executed in two or more counterparts, each of which shall be deemed an original, but all of which together shall constitute one and the same document.
Renter acknowledges receipt of a copy of this Agreement and acknowledges having read and understood the foregoing.

(a) Nothing in this Agreement is intended to exclude, restrict or modify the rights which either of the parties may have under the Australian Consumer Law. (b) A failure to comply with the Consumer Guarantee provisions under the Australian Consumer Law to the extent they apply to this Agreement, the Business' liability is limited to (at its election):
(i) in the case of a supply of goods: (A) replacing the goods or supplying equivalent goods; (B) repairing the goods; (C) paying the cost of replacing the goods or acquiring equivalent goods; or (D) paying the cost of having the goods repaired; and
(ii) in the case of a supply of services: (A) resupplying the services or (B) paying the cost of having the services supplied again.

Client will reimburse the Business for reasonable expenses incurred by the Business in the provision of services under this Contract subject to the Business making the Client aware of such expenses prior to them being incurred.

The Contract ends on of the parties ends the contract before that time. If one of the parties chooses to end the Contract prior to Project completion, the Client is responsible for paying for all work and costs incurred up until that date.
